What CPR Part 35 means for your instruction.

CPR Part 35 governs the use of expert evidence in civil proceedings in England and Wales. It sets out the expert's duties to the court and the requirements for expert reports.

Duty to the Court

The expert's primary duty is to the court, overriding any obligation to the instructing party. The expert must be, and be seen to be, independent.

Form of the Report

Expert reports must contain a statement of the expert's qualifications, the substance of instructions, and a declaration of truth and compliance.

Meetings of Experts

The court may direct that experts in the same discipline meet to identify areas of agreement and disagreement, and produce a joint statement.
